SPOKANE — A motion to dismiss second-degree murder and first-degree assault charges against Yvonne Wanrow has been rejected, and she has been ordered to stand trial October 11 in Spokane County Superior Court.
Judge William Williams said yesterday that after reviewing the case he did not find sufficient grounds for dismissal of charges. Ms. Wanrow's 1973 conviction on the same charges was overturned by the State Supreme Court on procedural grounds.
Lawyers for Ms. Wanrow, 32, a Colville Indian from Inchelium, have said William Wesler, 62, Spokane, was shot to death August 12, 1972, because she was trying to protect her children from being molested. David Kelley was shot and wounded in the same incident.
However, Fred Caruso, deputy prosecuting attorney, said Ms. Wanrow had been drinking heavily led Wesler to her home and then shot him.
Ms. Wanrow has drawn national civil-rights support, saying she was brought to trial because she is a woman and an Indian.
